 PART I PRELIMINARY
  
  hort title and application
  This Ordinance may be cited as the Money Lenders Ordinance.
  This Ordinance shall have effect notwithstanding any agreement
to the
  rary.
  nterpretation
  In this Ordinance, unless the context otherwise requires--
  pany" means a body corporate--
  incorporated under the Companies Ordinance (Cap. 32);
  incorporated by any other Ordinance; or

  qualified person" means a person in respect of whom there is in

  For the purposes of this Ordinance, where by an agreement for the
loan

  For the purpose of determining the amount of the principal of a 
loan,
  amount thereof which is not shown to have been lent except for 
the
  ose of treating it as an instalment paid by the borrower in 
repayment
  he loan and which is so treated by the lender shall be disregarded.
  References in this Ordinance to an assessor are references to a
person

  The Governor shall appoint a public officer to be the

  The Registrar shall establish and maintain a register in 
which he
  l cause to be kept particulars, other than specified particulars,
of--
  applications for the grant or renewal of licences; (Amended 69

  licences which are in force or have been revoked or suspended;
  such other matters, if any, as he thinks fit.
  In this section "specified particulars" means particulars 
furnished
  r section 8 which are specified in regulations made under 
section 34

  Except as may be necessary for the exercise or performance 
of any
  tion or duty under this Ordinance or for carrying into 
effect the
  isions of this Ordinance, the Registrar and every person 
employed in
  ying out or in assisting any person to carry out the 
provisions of
  Ordinance--
  shall preserve and aid in preserving secrecy with regard 
to all
  ers relating to the affairs of any person that may come 
to his
  ledge in the exercise or performance of any function or duty 
under
  Ordinance;
  shall not communicate any such matter to any person other 
than the
  on to whom such matter relates; and
  shall not suffer or permit any person to have access to any records
in
  possession, custody or control of any person to whom this 
subsection
  ies.
  
  Subsection (1) does not apply--
  to the disclosure of information in the form of a summary of 
similar
  rmation provided by a number of persons if the summary is so framed
as
  revent particulars relating to the business of any particular 
person
  g ascertained from it;
  to the disclosure of information with a view to the institution
of, or
  rwise for the purposes of, any criminal proceedings; (Replaced

  in connection with any civil proceedings arising out of, or 
relating
  section 22, 23, 24, 25, 27, 33, 33B or 36; or (Added 69 of 1988
s. 5)
  to the disclosure of information to the Financial 
Secretary, the
  etary for Monetary Affairs, or any public officer authorized 
by the
  ncial Secretary for the purposes of this paragraph where, 
in the
  ion of the Registrar, it is desirable or expedient that 
information

  Any person who--
  contravenes subsection (1); or
  aids, abets, counsels or procures any person to contravene
subsection
  commits an offence and shall be liable to a fine of $ 100,000 and 
to
  isonment for 2 years.
  nspection of register
  Any person shall be entitled on payment of the prescribed fee--
  to inspect the register during ordinary office hours and take 
copies
  ny entry; or
  to obtain from the Registrar a copy, certified by or 
under the
  ority of the Registrar to be correct, of any entry in the register.
  The Registrar shall give public notice, in such manner as he may 
deem
  of the place where and the times when the register may be
inspected.
  Documents admissible in evidence
  cument purporting to be a copy, certified by or under the
authority of
  Registrar to be true and correct, of any entry in the register

  dmissible in evidence in criminal or civil proceedings 
before any

  ed, the court shall presume that--

 PART II LICENSING OF MONEY LENDERS
  
  estriction on carrying on of business of money lender
  No person shall carry on business as a money lender--
  without a licence;
  at any place other than the premises specified in such licence;
or
  
  rwise than in accordance with the conditions of a licence.
  A licence shall be in the prescribed form.
  pplication for licence and public notification of application
  An application for a licence shall be made to the Registrar in 
the
  cribed form and in the prescribed manner, and shall be accompanied 
by
  prescribed fee and a statement in writing containing the 
prescribed
  iculars in respect of the application.
  An application made under this section in respect of a company
may be
  by any person authorized in that behalf by such company. (Amended 
69
  988 s. 7)
  An application made under this section in respect of partners 
in a
  may be made by any such partner.
  The Registrar shall, in such manner as may be prescribed, give 
public
  ce of every application made under this section.
  nvestigation and lodgement of applications
  Where an application is made under section 8, the applicant 
shall at
  same time send a copy of the application to the 
Commissioner of
  ce, and the Commissioner of Police may cause an investigation 
to be
  ied out in respect of the application for the purpose of 
determining
  her, in the opinion of the Commissioner of Police, there are 
grounds
  objecting to the application under section 11.
  For the purpose of carrying out an investigation under this 
section,
  Commissioner of Police may in writing require the applicant to
produce
  inspection such books, records or documents or to 
furnish such
  rmation relating to the application or any business carried 
on or
  nded to be carried on by him as the Commissioner of 
Police may
  ify.
  In respect of an application made under section 8, no step other 
than
  registration of such application shall be taken by the Registrar
prior
  
  the date on which a period of 60 days after the date on which 
the
  ication is made expires; or
  the date on which the Commissioner of Police notifies the 
Registrar
  any investigation carried out under this section in respect of 
the
  ication has been completed, whichever is the earlier (in this 
section
  rred to as "the material date").
  Where the Registrar or the Commissioner of Police intends to 
object
  r section 11 to any application for a licence, he shall, not 
later
  7 days after the material date, serve notice on the applicant of 
his
  ntion to object and of the grounds of such objection; and where 
such
  ce is served by the Commissioner of Police, he shall send a 
copy
  eof to the Registrar.
  Upon the expiration of a period of 7 days after the material date 
in
  ect of any application made under section 8, the Registrar shall
lodge
  application with such magistrate as he deems fit, together with
a copy
  ny notice served on the applicant under subsection (4).

  The Registrar shall give notice to the Commissioner of Police of 
any
  ement made under subsection (5).
  
  Licensing court
  Where an application is lodged under section 9 (5), the 
licensing
  t shall hear and determine the application in accordance with
section
  
  For the purposes of hearing and determining an application 
lodged
  r section 9 (5), the licensing court shall be constituted by-
-
  where no notice has been served on the applicant under section 
9 (4)
  1 (2) (b) (i), subject to subsection (3), a magistrate sitting 
alone;
  
  where a notice has been served on the applicant under section 9
(4) or
  2) (b) (i), a magistrate sitting with 2 assessors.
  Without limiting the generality of the power of the licensing 
court
  r section 10B (f) to adjourn the hearing of an application 
lodged
  r section 9 (5), the licensing court shall, where--
  it is constituted by a magistrate sitting alone; and
  it grants leave under section 11 (2) (b) (ii) to a person to object
to
  application, adjourn the hearing to another date to be 
heard and
  rmined by the licensing court constituted by a magistrate sitting
with
  sessors.
  Where the licensing court is constituted by a magistrate sitting 
with
  sessors, the decision of the licensing court shall be that 
of the
  rity of the members and shall be recorded in writing:
  ided that the magistrate's rulings on matters of law shall bind 
the
  nsing court.
  The Registrar shall be provided with a copy of each decision of 
the
  nsing court. (Replaced 69 of 1988 s. 9)
  Selection of assessors and payment of fees to assessors
  Where under this Ordinance the licensing court is required 
to be
  tituted by a magistrate sitting with 2 assessors, the Registrar
of the
  eme Court shall select those assessors.
  Where an assessor selected under subsection (1) attends the 
licensing
  t for which he has been so selected, he shall, irrespective of
whether
  its as an assessor, be paid a fee of an amount equal to the fee 
fixed
  r section 7A (2) of the Magistrates Ordinance (Cap. 227) to be
paid to
  ssessor for his services. (Added 69 of 1988 s. 9)
  Powers of licensing court
  ect to this Ordinance, the licensing court may determine 
its own
  edure and in particular may--
  receive and consider any material, whether by way of oral 
evidence,
  ten statements, documents or otherwise, notwithstanding 
that such
  rial would not be admissible in evidence in civil or 
criminal
  eedings;
  by notice in writing signed by the presiding magistrate, require 
any
  on to attend before it at any hearing and to give evidence and
produce
  ments;
  administer oaths and affirmations;
  examine on oath, affirmation or otherwise any person attending 
before
  t any hearing and require such person to answer all questions put 
by
  ith its consent;
  determine the manner in which the material referred to in
paragraph
  shall be received; and
  adjourn any hearing from time to time as it may deem fit, and may 
do
  things--
  ancillary to the powers conferred by this section; or
  reasonably necessary for the discharge of its functions under 
this

  Immunity
  -
  member of the licensing court; and
  witness, party to any proceedings, representative or other 
person
  aring before the licensing court, shall have the same privileges 
and
  nities in any proceedings before the licensing court or 
in the
  cise of the licensing court's functions as he would have

  Determination of application for licence
  The licensing court shall fix a date for the hearing of an
application
  ed under section 9 (5) and shall give 14 clear days' notice of

《上海市文物经营管理办法》已经2001年1月2日市政府第83次常务会议通过,现予发布,自2001年4月1日起施行。

第一条 (目的和依据)
为了加强本市文物经营的管理,保护国家历史文化遗产,根据《中华人民共和国文物保护法》(以下简称《文物保护法》)及其实施细则等法律、法规,结合本市实际情况,制定本办法。
第二条 (适用范围)
本办法适用于本市范围内文物的经营及其管理活动。
第三条 (管理部门)
上海市文物管理委员会(以下简称市文管委)负责本市文物经营的管理工作。
各级公安、海关、工商、物价、税务、商业等行政管理部门应当按照各自的职责,配合做好文物经营管理工作。
第四条 (许可制度)
本市对文物经营活动实行许可制度。
未经市文管委许可,任何单位和个人不得从事文物的经营活动。
第五条 (经营许可证)
需要从事文物经营的,应当向市文管委申领《文物经营许可证》。《文物经营许可证》分为甲、乙两类。
甲类《文物经营许可证》的经营范围为国家规定可以经营的各个时期的文物;乙类《文物经营许可证》的经营范围为国家规定可以经营的1911年以后的文物,但国家文物局确定的具有重要历史、文化、艺术价值的除外。
第六条 (文物经营条件)
申请甲类《文物经营许可证》的单位,应当具备下列条件:
(一)有3名以上取得市文管委颁发的《文物经营资格证》的从业人员,其中至少有1名是取得文博系列中级职称或者具有与文物相关专业大专以上学历的专业人员;
(二)有固定的并符合市文管委规定面积的营业场所。
申请乙类《文物经营许可证》的单位和个体工商户,应当具备下列条件:
(一)有1名以上取得市文管委颁发的《文物经营资格证》的从业人员;
(二)有固定的并符合市文管委规定面积的营业场所。
第七条 (文物交易市场的设立条件)
申请设立文物交易市场的,应当具备下列条件:
(一)申请人为企业;
(二)有固定的与交易活动相适应的经营场地;
(三)有3名以上取得市文管委颁发的《文物经营资格证》的管理人员。
第八条 (文物拍卖、典当企业的条件)
拍卖、典当的企业在向有关主管部门申请从事文物拍卖、典当前,其从业人员应当经市文管委考核,并取得《文物经营资格证》。其中,经营文物拍卖企业应当具有3名以上持有《文物经营资格证》的从业人员;经营文物典当企业应当具有1名以上持有《文物经营资格证》的从业人员

第九条 (申请经营文物提供的材料)
申请《文物经营许可证》时,应当提供下列材料:
(一)文物经营申请登记表,内容由市文管委规定;
(二)从业人员的资格证明;
(三)营业场所的房屋产权证明或者租赁合同备案登记证明。
第十条 (申请设立文物交易市场提供的材料)
申请设立文物交易市场时,应当提供下列材料:
(一)文物交易市场申请登记表,内容由市文管委规定;
(二)申请人的证明文件;
(三)经营场地的证明材料;
(四)管理人员的资格证明;
(五)文物交易市场的章程。
第十一条 (审批程序)
市文管委应当在接到申请材料之日起15个工作日内审批完毕。对符合条件的,颁发《文物经营许可证》或者文物交易市场批准文件;不符合条件的,书面告知申请人。
申请人凭《文物经营许可证》或者文物交易市场批准文件,向所在地区、县公安部门申领《特种行业许可证》,然后到所在地的工商行政管理部门办理登记注册,领取营业执照后方可经营。
第十二条 (变更与终止)
文物经营者变更《文物经营许可证》核定的经营范围的,应当经市文管委审核批准后,到所在地区、县公安部门和工商行政管理部门办理变更登记。
文物经营者变更名称、法定代表人、地址的,应当到所在地区、县公安部门和工商行政管理部门办理相应的变更登记,并在登记之日起30日内向市文管委备案。
文物经营者终止经营的,应当向市文管委、所在地区、县公安部门和工商行政管理部门办理注销手续,并向市文管委缴回《文物经营许可证》。
第十三条 (亮证经营)
文物经营者必须在经营场所的显著位置,悬挂《文物经营许可证》。
第十四条 (禁止行为)
文物经营者应当遵守国家和本市有关法律、法规和规章,不得经营国家明令禁止经营的文物;文物经营禁止转承包。
文物经营者应当按照《文物经营许可证》核准的经营范围从事经营活动,禁止超越范围经营。
第十五条 (文物销售要求)
文物经营者在销售文物时,应当真实提供文物的名称、年代、瑕疵等基本情况。
第十六条 (文物收购、寄售、典当的要求)
文物经营者在收购或者接受寄售、典当文物时,应当要求出售、寄售、典当者出示单位证明或者个人身份证明,并予以登记。
典当文物成为死当物品时,应当经市文管委鉴定、许可后,方可处理。
前款所称的死当物品是指,依法或者按照双方当事人约定的典当期满后,典当者既不赎当又不续当的当物。
第十七条 (交易市场要求)
文物交易市场应当建立场所内部管理制度,负责对入场经营者的管理;禁止无《文物经营许可证》的经营者进入交易场所从事文物经营活动。
第十八条 (文物拍卖要求)
拍卖人应当在发布拍卖公告日15日前,其中拍卖的文物在500件以上的,应当在发布拍卖公告日30日前,向市文管委报送《文物拍卖标的申请鉴定表》和《文物拍卖标的申请鉴定清册》,经市文管委鉴定、许可后,文物方可拍卖。
拍卖企业不得从事文物的收购、销售活动。
第十九条 (经营允许出境文物的要求)
取得甲类《文物经营许可证》的经营者,可以向税务部门申请印制文物古籍外销统一发票。销售允许出境的文物,在销售前应当经国家指定的文物出境鉴定机构鉴定、许可,并钤盖允许出境的标识后,方可销售。
销售、拍卖没有钤盖允许出境标识的文物,文物销售者或者拍卖人应当在销售或者拍卖前向购买者或者买受人告知下列内容:
(一)所购或者所拍得的文物可以或者不可以出境;
(二)可以出境的文物需要出境的,应当按有关规定向国家指定的文物出境鉴定机构办理出境鉴定、许可手续。
第二十条 (优先收购权)
国有文物收藏单位在征集文物藏品时需要行使优先收购权的,应当经市文管委审核批准。文物经营者在同等条件下应当优先供应。
第二十一条 (无馆藏价值文物的处理)
国有文物收藏单位保存的文物中,属于无馆藏价值需要处理的,应当经市文管委审核批准后,进行公布出售或者拍卖。
国有文物收藏单位对接受捐赠的文物不得擅自处理;特殊情况需要处理的,应当由受赠单位组织专家鉴定、论证后,报市文管委审核批准,但捐赠双方已有约定的除外。
第二十二条 (许可证年审)
《文物经营许可证》每年验审一次。未经年审或者年审不合格的,不得继续从事文物经营活动。
第二十三条 (处罚)
对于违反本办法规定的单位和个人,《文物保护法》及其实施细则有处罚规定的,从其规定;没有规定的,按照下列规定给予处罚:
(一)有下列行为之一的,由市文管委责令限期改正;逾期未改正的,处以2000元以上1万元以下的罚款:
1、经营者未真实提供文物的名称、年代、瑕疵等基本情况的;
2、典当的文物形成死当物品后,未经市文管委鉴定、许可,典当企业自行处理的;
3、文物经营转承包的。
(二)国有文物收藏单位未经批准处理无馆藏价值文物的,由市文管委给予警告,责令其追回处理的文物,并可处以1万元以上3万元以下的罚款;同时由其单位或者上级主管部门对主要责任人给予行政处分。
(三)文物经营者未经年审的,市文管委应当责令其限期改正,逾期不年审的或者年审不合格而继续从事文物经营活动的,由市文管委给予警告,并可处以5000元以上2万元以下的罚款。
第二十四条 (强制鉴定)
拍卖人拍卖的文物未经鉴定、许可的,市文管委可以对拍卖的文物进行强制鉴定,并在5个工作日内作出鉴定结论。
市文管委在调查或者检查过程中,收集证据时,可以对涉嫌违法经营的文物进行强制鉴定,并在5个工作日内作出鉴定结论。
第二十五条 (依法罚没财物的处理)
罚没款按规定上缴国库。依法没收的文物,经鉴定符合国家规定馆藏标准的,无偿移交国有文物收藏单位收藏;不符合国家规定馆藏标准的,由市文管委指定的拍卖企业拍卖,所得款项按规定上缴国库。
第二十六条 (复议和诉讼)
当事人对行政管理部门作出的具体行政行为不服的,可以按照《中华人民共和国行政复议法》和《中华人民共和国行政诉讼法》的有关规定,申请行政复议或者提起行政诉讼。
当事人在法定期限内不申请复议,不提起诉讼,又不履行具体行政行为的,市文管委可以依法申请人民法院强制执行。
第二十七条 (不可移动文物的适用)
不可移动文物的经营及其管理,按照国家有关规定执行。
第二十八条 (应用解释部门)
市文管委可以对本办法的具体应用问题进行解释。
第二十九条 (施行日期)
本办法自2001年4月1日起施行。1995年2月6日上海市人民政府发布的《上海市文物市场管理办法》同时废止。

  第一章总则

  第一条为了加强普陀山风景名胜区(以下简称风景区)的管理,有效保护和合理利用风景名胜资源,根据有关法律、行政法规的规定,结合风景区的实际,制定本条例。

  第二条本条例适用于风景区的规划、保护、利用和管理。

  第三条风景区是以佛教名山和海岛自然风光为主要特色的国家级风景名胜区,由普陀山(含豁沙山,下同)、洛迦山和朱家尖东部三部分组成,具体范围按照国务院批准的《普陀山风景名胜区总体规划》执行。

  第四条风景区的规划、保护、利用和管理应当遵循科学规划、统一管理、严格保护、永续利用的原则。

  第五条普陀山风景名胜区管理委员会在舟山市人民政府的领导下,依法负责普陀山、洛迦山的规划、保护、利用和统一管理工作。

  普陀区人民政府依法负责朱家尖东部的规划、保护、利用和统一管理工作。

  第六条普陀山风景名胜区管理委员会依法行使下列职权:

  (一)宣传和贯彻有关法律、法规、规章;

  (二)负责风景名胜资源、自然生态环境的保护和管理,合理利用风景名胜资源;

  (三)负责普陀山、洛迦山规划建设、环境保护、旅游、安全生产、宗教事务、社会治安、环境卫生、文化市场等管理工作;

  (四)组织交通、通讯、电力、给排水和接待服务等基础设施建设;

  (五)行使舟山市人民政府依法授予的和有关行政管理部门依法委托的其他管理职权。

  普陀山风景名胜区管理委员会的有关行政管理活动应当接受舟山市人民政府相应行政管理部门的业务指导和监督。

  第七条依法保障风景区内宗教团体、宗教活动场所的合法权益和正常的宗教活动。

  风景区内的宗教团体、宗教活动场所应当遵守国家和省有关宗教事务管理的法律、法规和规章。

  第二章规划

  第八条风景区规划分为总体规划和详细规划,由省建设行政管理部门组织编制。

  总体规划由省人民政府审查后,报国务院审批。

  详细规划由省建设行政管理部门报国务院建设行政管理部门审批。

  第九条编制风景区规划应当征求政府有关部门、宗教团体和社会公众的意见;涉及军事设施的,应当征求军事机关的意见;必要时,应当举行听证。

  风景区规划的具体编制工作,应当采用招标等公平竞争方式选择具有相应资质等级的单位承担。

  第十条总体规划应当突出风景区佛教名山、海岛自然风光的文化内涵和自然特性,并应当将风景区内人文、自然景观最集中、最具观赏价值、最需要严格保护的区域,划为核心景区。

  详细规划应当根据总体规划编制,按照核心景区和其他景区的性质、特点、范围,确定景点保护方案和基础设施、游览设施、文化设施等建设项目的选址、布局与规模,并明确建设用地范围和规划设计条件等。

  第十一条风景区规划经批准后,应当向社会公布,任何组织和个人有权查阅。

  经批准的风景区规划是风景区保护、利用、建设和管理的依据,任何单位和个人必须严格执行,不得擅自修改。

  确需对风景区规划有关内容进行修改的,应当按照国家规定权限和程序报经批准或者备案。

  因修改和实施风景区规划对公民、法人或者其他组织造成财产损失的,应当依法给予补偿。

  第三章保护

  第十二条普陀山风景名胜区管理委员会、普陀区人民政府及有关部门应当建立健全风景名胜资源保护制度,加强对风景区海岸沙滩、岩石岛屿、地形地貌、水体、植被、野生动物等自然景观和宗教建筑、文物古迹、摩崖石刻等人文景观及其所处环境等风景名胜资源的保护,做好风景名胜资源调查登记和风景区绿化、林木养护、防火、病虫害防治及其他自然灾害的预防工作。

  第十三条禁止以任何名义和方式侵占、出让或者变相出让风景名胜资源和风景区土地。

  第十四条风景区内禁止从事下列破坏风景名胜资源的活动:

  (一)危害文物安全,改变文物原状和周边环境;以刻划涂写等方式故意损坏国家保护的文物古迹;

  (二)擅自捕猎野生动物或者采集野生植物,损毁或者擅自迁移、修剪古树名木;

  (三)开山、开矿、采石、采砂;

  (四)在公墓区外新建、改建和翻修坟墓;

  (五)在景物、围栏等设施上刻划涂污、钉挂和绑扎物件;

  (六)生产、经营、运输、携带、燃放烟花爆竹;

  (七)烧荒或者在禁火区内吸烟、生火、烧香点烛;

  (八)其他破坏风景名胜资源的活动。

  第十五条风景区内的建设应当严格遵守风景区规划。

  风景区内的违法建(构)筑物、设施,应当依法限期改正或者拆除。

  第十六条风景区内禁止修建储存爆炸性、易燃性、放射性、毒害性、腐蚀性物品的仓库、堆场;核心景区外确因居民生活需要设置小规模燃气站、加油站的,必须符合国家安全技术标准。

  第十七条风景区内禁止设立各类开发区。

  在普陀山前山、中山、佛顶山及其他核心景区内禁止违反规划新建、扩建各类休养所(院)、招待所、宾馆、培训中心、度假村、商业用房、歌舞厅及与风景名胜资源保护无关的其他建(构)筑物、设施。

  第十八条严格控制风景区居民住宅建设。确需新建居民住宅的,应当在风景区规划确定的住宅用地内,按照统一规划建造,并严格控制建设规模、用地面积和容积率。

  规划住宅用地外的现有住宅不得翻建、改建、扩建,但确因危房维护、消防安全等需要翻建、改建的除外。

  第十九条风景区内建设项目的选址、布局应当符合风景区规划;建(构)筑物、设施的高度、体量、造型、色调等,应当保持风景区特色,与周围景观和环境相协调。

  按照国家有关规定应当进行环境影响评价的建设项目,建设单位应当组织编制环境影响评价文件,并依法报经批准。

  第二十条在风景区内从事建设活动的单位和个人应当制定污染防治和水土保持方案,在施工现场设置警示标志和安全防护围档,保护周围景观和环境;工程结束后应当及时清理临时性建(构)筑物、设施及物料临时堆场,恢复环境原貌。

  第二十一条风景区内军事设施的保护,按照《中华人民共和国军事设施保护法》和国家有关规定执行。

  风景区内军队的非军事设施建设应当遵守本条例。

  第四章管理和利用

  第二十二条普陀山风景名胜区管理委员会、普陀区人民政府应当加强安全管理,制定和完善事故应急预案,预防和控制各类事故的发生。

  风景区发生安全事故时,普陀山风景名胜区管理委员会、普陀区人民政府应当根据情况,立即启动相应事故应急预案,采取有效措施,组织抢救,防止事故扩大,并按照有关规定及时上报。

  第二十三条普陀山风景名胜区管理委员会、普陀区人民政府应当根据总体规划规定的游客容量和机动车控制规模,确定合理的游览接待规模,控制机动车使用数量。

  风景区人口规模和机动车使用数量控制办法,由舟山市人民政府另行制定,报省人民政府备案。

  第二十四条普陀山风景名胜区管理委员会、普陀区人民政府应当完善风景区内的服务设施和安全设施,设置规范的指示标志、安全警示标志,并做好设施、标志的日常检查和维护工作。

  第二十五条风景区内交通等服务项目,由普陀山风景名胜区管理委员会、普陀区人民政府根据公开、公平、公正原则,采用招标、挂牌或者随机确定等公平竞争方式确定经营者,并与经营者签定合同,依法确定各自的权利义务。

  经营者应当按照规定缴纳风景名胜资源有偿使用费。

  第二十六条风景区门票收入和风景名胜资源有偿使用费,实行收支两条线管理,专门用于风景名胜资源的保护和管理、相关基础设施建设及风景区内财产所有权人、使用权人损失的补偿。

  风景区门票收入和风景名胜资源有偿使用费的管理、使用及审计监督,按照国家有关规定执行。

  第二十七条普陀山风景名胜区管理委员会、普陀区人民政府应当加强风景区环境卫生管理,设置必要的卫生设施,对风景区内的垃圾组织统一清运和无害化处理。

  风景区各类车辆应当保持车容车貌整洁。装运垃圾、砂石等的车辆应当达到密闭化运输要求,防止运载物体撒落。进出建筑工地的车辆应当设置轮胎除泥装置,不得带泥上路。

  第二十八条风景区内经营者的经营场所、服务内容,应当符合风景区商业网点规划。工商行政管理部门在核发营业执照时,应当执行风景区商业网点规划。

  经营者应当在指定地点、区域和规定的营业范围内依法经营、文明经商,禁止擅自搭棚、设摊、设点、扩面经营。

  第二十九条政府及有关部门应当加强对风景区商品和服务价格的监督检查,在重要节假日、节庆等活动期间,可以按照规定权限和程序对住宿、餐饮等重要商品和服务价格实行必要的干预措施。

  第三十条在重要节假日、节庆等活动期间需要控制游客数量的,普陀山风景名胜区管理委员会、普陀区人民政府应当提前一周在相关媒体、进山码头、风景区内发布相关公告,并采取措施保障景区安全及交通运输、住宿、餐饮等服务。

  第三十一条风景区内禁止从事下列违反管理秩序的活动:

  (一)违法排放废气、废水、噪声,违法倾倒固体废弃物;

  (二)随意丢弃塑料袋、易拉罐、餐盒等垃圾;

  (三)擅自在佛教放生池塘捕捞水生动物;

  (四)在明令禁止的区域游泳、游玩、攀爬;

  (五)经营性饲养或者放养家畜家禽,在核心景区和居民小区饲养家畜家禽;

  (六)违法引进或者带入外来物种及未经依法检疫的动植物及其产品;

  (七)强行向游客提供服务或者兜售商品;

  (八)以纠缠、强行讨要等滋扰他人的方式乞讨;

  (九)假冒僧尼从事宗教活动或者募化活动;

  (十)其他违反风景区管理秩序的活动。

  第三十二条在普陀山、洛迦山从事下列活动,应当经普陀山风景名胜区管理委员会审核同意后,按照有关法律、法规的规定办理审批手续:

  (一)设置雕像或者塑造塑像,恢复或者新增摩崖石刻、碑碣;

  (二)建(构)筑物的翻建、改建、扩建;

  (三)因施工等需要搭建临时性建(构)筑物、设施或者临时堆放物料,开挖或者临时占用绿地;

  (四)因更新抚育等原因砍伐林木;

  (五)利用文物、景物、景点拍摄电影、电视;

  (六)其他影响生态或者景观的活动。

  第三十三条普陀山风景名胜区管理委员会应当采取有效措施,完善普陀山公共交通,保障交通安全畅通,逐步减少非机动车数量。

  摩托车、拖拉机、电动自行车不得在普陀山、洛迦山行驶。

  第三十四条普陀山风景名胜区管理委员会不得从事以营利为目的的经营活动。普陀山风景名胜区管理委员会工作人员不得在风景区内的企业兼职。

  第五章法律责任

  第三十五条在普陀山、洛迦山有违反本条例第十四条第(四)项、第(五)项和第(七)项规定的行为之一的,由普陀山风景名胜区管理委员会按照有关法律、法规的规定处理。

  第三十六条在普陀山、洛迦山有违反本条例第二十七条第二款规定,装运垃圾、砂石等的车辆未达到密闭化运输要求,或者进出建筑工地的车辆未设置轮胎除泥装置的,由普陀山风景名胜区管理委员会责令限期改正;逾期不改正的,处二千元以上二万元以下的罚款。

  第三十七条在普陀山、洛迦山有违反本条例第三十一条规定的下列行为之一的,由普陀山风景名胜区管理委员会按照下列规定处理:

  (一)违反第(三)项、第(四)项规定,擅自在佛教放生池塘捕捞水生动物,或者在明令禁止的区域游泳、游玩、攀爬的,责令停止违法行为,可处五十元以上五百元以下的罚款;

  (二)违反第(五)项规定,经营性饲养或者放养家畜家禽,或者在核心景区和居民小区饲养家畜家禽的,责令限期改正,可处三百元以下的罚款。

  第三十八条违反本条例规定的其他行为,法律、其他法规已有法律责任规定的,由有关行政管理部门或者其依法委托的普陀山风景名胜区管理委员会所属执法机构按照法律、法规规定处理。

  第三十九条行政管理部门工作人员在风景区保护管理工作中滥用职权、玩忽职守、徇私舞弊的,按照管理权限对负有责任的主管人员和直接责任人员依法给予行政处分。

  第四十条违反本条例规定,造成损失的,依法承担赔偿责任;构成犯罪的,依法追究刑事责任。

  第六章附则

  第四十一条本条例自2008年10月1日起施行。2005年12月27日省人民政府发布的《浙江省普陀山风景名胜区保护管理办法》同时废止。
